Privacy Policy

Personal Information is any information or an opinion about an identified individual or an individual who can be reasonably identified from the information or opinion. Information or an opinion may be Personal Information regardless of whether it is true.

We collect Personal Information that is reasonably necessary for, or directly related to, our functions or activities. The types of Personal Information we collect include (but are not limited to):

• contact details (such as phone number, email address, mailing address);
• date of birth;
• gender;
• employer name and job title (if applicable);
• course attendance, participation and assessment information;
• payment and transaction information; and
• any additional information you provide us voluntarily.

Sensitive information refers to types of Personal Information that are higher risk, such as health information, including pregnancy, disabilities, pre-existing medical conditions or injuries. We may collect sensitive information where necessary, with your consent or as otherwise authorised by law.

We collect Personal Information in a variety of ways, including:

• when you or your organisation provide it directly to us (e.g. through paper or online forms, emails, phone calls or other correspondence);
• when you register for, attend, or complete our in-person training or eLearning courses;
• through your interactions with our website, social media, or digital forms; and
• from third parties, such as your employer or our approved training providers.

If you interact with us via a social media platform, you agree to allow us to receive information about you from the social media platform, which may include your Personal Information (if you directly communicate with us via the social media platform), information about your visits and interaction with our website.

If you provide us with Personal Information about another individual (e.g. a colleague or employee), you must ensure that you are authorised to do so and that the individual is aware of this Privacy Policy.

We collect, hold and use your Personal Information so that we can:

• deliver and manage training, including assessment, certification and recordkeeping;
• obtain your confirmation that you are fit and able to participate in physical skills modules;
• record and investigate (and potentially notify your employer of) any injuries or health related incidents that occur during training;
• share with your employer the fact you disclosed a health condition to us (note that we will not share the details of the health condition, only that you declared one which meant you were unable to complete some or all of the program);
• communicate with you and respond to your enquiries or complaints, and to provide customer support;
• administer contracts with clients and suppliers;
• comply with our legal obligations and resolve disputes;
• verify certification and managing replacement requests;
• maintain business records and comply with legal obligations;
• manage risk, including insurance, incident reporting and legal claims; and
• send direct marketing communications (where permitted) about our products and/or services, promotions and events that may be of interest to you.

If you do not provide us with your Personal Information, we may not be able to provide you with our products or services, consider you for a job with us, communicate with you or respond to your enquiries.

We take reasonable steps to protect your Personal Information from unauthorised access, interference, disclosure, or destruction. These include:

• secure servers and encrypted data transmission;
• access controls and confidentiality agreements; and
• regular reviews of our data security systems.

We store most Personal Information in computer systems and databases (including cloud service providers) operated either by us or our external service providers. Some Personal Information is recorded in paper files that we store securely.

We will take reasonable steps to destroy or de-identify Personal Information once it is no longer required, unless we are legally required to retain it.

We have put in place procedures to deal with any suspected or actual data security breach and will notify you and any applicable regulator of a breach where we are legally required to do so.

We may transfer or disclose your Personal Information to our related companies.

We may disclose your Personal Information to third parties including:

• your employer or organisation;
• our trainers, assessors, and contractors;
• our service providers (e.g. CRM, LMS, payment providers, cloud storage providers);
• our legal or professional advisers, insurers, and auditors;
• government agencies or regulators as required by law; or
• any third party to whom we sell or transfer part of our business.

Some of these recipients may be located outside Australia. If so, we will take reasonable steps to ensure that they comply with the Privacy Act or are otherwise subject to equivalent protections.

We may also disclose your Personal Information to others where: 

• we are required or authorised by law to do so;
• you have expressly consented to the disclosure, or consent may be reasonably inferred from the circumstances; or
• we need to share it with data processors to operate our business and provide products or services to you.

A cookie is a small file which asks permission to be placed on your computer's hard drive. Once you agree, the file is added and the cookie helps analyse web traffic or lets you know when you visit a particular site. Cookies allow web applications to respond to you as an individual. The web application can tailor its operations to your needs, likes and dislikes by gathering and remembering information about your preferences.

There is no charge for requesting access to your Personal Information, but we may require you to meet our reasonable costs in providing you with access (such as photocopying costs or costs for time spent on collating large amounts of material).

We will respond to your requests to access or correct Personal Information in a reasonable time and will take all reasonable steps to ensure that the Personal Information we hold about you remains accurate, up-to-date and correct.

If you have a complaint about how we have handled your Personal Information, please contact us using the details set out below. We will consider your complaint, determine whether it requires further investigation, and respond within a reasonable timeframe. We will notify you of the outcome of any investigation and any subsequent internal investigation.
